As the Supreme Court prepares to deliver its verdict on the Osun governorship election, it is essential to note some crucial points from the previous Appeal Court judgment, which favored Senator Ademola Adeleke. The Appeal Court, which has three judges as members, gave a unanimous decision, and their verdict is outlined below:
Adeleke did not forge any certificate, which was one of the grounds used by Alhaji Oyetola and the APC to challenge Adeleke's victory declaration. Even at the Tribunal, it was declared that there was no forgery in the document submitted to INEC.
Oyetola and APC did not provide any proof of overvoting at the Tribunal. The overvoting allegations were one of the grounds used by Oyetola/APC in challenging Adeleke's victory, but they were unable to prove these allegations.
Oyetola/APC witness called to testify and prove overvoting was not an expert in the field. Therefore, the evidence was insufficient to testify before the court.
The court awarded a fine of #500,000 to be paid by Oyetola in favor of the Appellant, which means that the court did not just award a fine in litigation without finding the case null and void.
It is worth mentioning that the Apex Court may dismiss Oyetola/APC's appeal against the Appeal Court's judgment, which covers all the areas of the grounds challenged from the Tribunal stage.
